En otras palabras: comenzó la guerra cívica. Nuestra respuesta civil a su tercera fase.<br /><br />Por Antonio Sánchez García<br /><br />1<br /><br />La sociedad democrática está recibiendo lecciones de resistencia anti dictatorial a pasos agigantados. Ayer aprendió que los votos poco cuentan para el tirano: se los pasa por el forro cuando le incomodan las entrepiernas. Tanto como las marchas, cuando no son las suyas. A los votos, responde sin más trámite con un decreto parido por su ministra de leyes, la señora Cilia Flores y nombrando tiranuelas obsecuentes para aplastar la voluntad ciudadana. A las marchas, “gas del bueno” y perdigones disparados por sus esbirros de la Guardia Nacional. Por ahora, que pronto, si lo permitimos, los ataques contra las fuerzas opositoras irán a mayores. Mañana: ¡ay mañana! ¿Nos dejaremos poner un tatuaje en la muñeca y una estrella en el pecho, como los judíos de Hitler? ¿Permitiremos que se lleven a nuestros líderes a campos de concentración o los lancen a patadas al destierro - ya lo han hecho con Carlos Ortega, con Eduardo Lapi, con Rosales, por sólo nombrar a los más destacados - como en los siniestros tiempos del nazismo alemán?<br /><br />Se equivoca el tirano y se equivocan los opositores que se apresuran a descalificar marchas y votos. Pues ahora es cuando. Precisamente ahora, cuando los obreros del petróleo y de las industrias básicas, los pescadores y enfermeras, enfermeros, médicos y maestros y todos aquellos millones de venezolanos que dependen de un salario y sufren la espantosa voracidad de la inflación, es cuando más deberemos marchar. Y si de votos se trata, más deberemos votar. No hacerlo sería darle en el gusto al dictador y caer en la larga y tenebrosa catalepsia de los Salazar, los Franco, los Trujillo, los Somoza, los Castro y los Stalin. O en la oscura noche de las dictaduras de los Gómez, los Pérez Jiménez, los Batista, los Pinochet y los Videla. E hijos de Bolívar y Betancourt, como somos los millones de venezolanos, no aceptaremos que un tirano de cuarta se ponga la cachucha de Juan Vicente o el quepís de Fidel Castro. En otras palabras: comenzó la guerra. Nuestra respuesta cívica y civilista a su tercera fase.<br /><br />2<br /><br />¿Qué hacer? Marchar cuando haya que marchar. Si bien con un plan B. ¿Se nos encajona y se nos encierra como a bestias de matadero? Llevamos la fórmula alternativa. Este 1 de mayo, por ejemplo, en lugar de volvernos como pendejos por la Colón debimos habernos agarrado la autopista. Y quedarnos en ella tanto como hubiéramos resistido. No había allí quien nos lo impidiera. ¿Qué hubieran ampliado el bombardeo? Seguro: más fotos para el Washington Post, para Le Monde y para El País de España. Más informes a las cancillerías del mundo. Más y más desprestigio para quien ya es de facto el clásico dictador tercermundista.<br /><br />¿Votar? No sólo hacerlo cuando debamos hacerlo, sino exigir hacerlo. ¿Por qué no exigimos el cumplimiento de la agenda electoral determinada por nuestra Carta Magna y elegimos a los concejales ESTE AÑO como manda y ordena la Constitución y no cuando le salga del forro al teniente coronel y nos imponga su calendario a través de sus esbirros y lacayos del CNE? De manera que debemos votar y defender nuestro derecho a hacerlo cuando corresponda. O nos gobierna la Constitución y luchamos con ella en la mano o nos calamos el forro presidencial.<br /><br />Ya habrá tiempo para múltiples paros escalonados y paros mayores, grandes y pequeños, focalizados y cotidianos, hasta que se conviertan en el pan de cada día que le amargue la digestión del dulce de lechosa al tirano. Y les espaturre el maquillaje a las mujercitas de sus poderes de choque. En tiempos democráticos una docena de encapuchados dirigidos por Elías Jaua paralizaba con sus acciones relámpagos todos los jueves el tránsito capitalino. Sangrientos y criminales golpes de Estado, huelgas, saqueos y motines fueron las armas que le pavimentaron al teniente coronel el asalto al Poder. El voto fue la torta de la guinda. ¿Quién cree que saldrá a sombrerazos electorales? Nuestra vía conduce a un sinfín de actividades perfectamente constitucionales, legales y pacíficas, que debemos llevar a cabo refugiándonos en el 333 y en el 350. Si el tirano viola la Constitución, nosotros estamos obligados a acatarla y defenderla refugiándonos en la desobediencia civil. Con el supremo objetivo de restablecerla en la plenitud de su fuerza y soberanía. La Constitución, la Bandera y la Patria: esas son nuestras mortíferas armas. La dignidad y la decencia, nuestros escudos. Han terminado por imponerse doquiera reventara el furúnculo de la tiranía.<br /><br />Nadie está llamando a golpes ni a cachuchas. Dios nos libre de ellas. En estos diez años demasiados uniformados han mostrado su bajeza de cuerpo entero. Pero constitucionalistas, dignos y decentes los habrá en cantidades suficientes – hoy silenciados y acorralados - y en ellos hemos de fiarnos para el futuro de libertades que se avizora. Los que aún dudan, que tengan presente el Estatuto de Roma. Y vayan decidiendo escoger entre el pueblo o el tirano. Entre el déspota o el soberano. Estamos llamando a la gran insurrección democrática, pacífica y popular que barrerá con esta lacra que nos aplasta.<br /><br />Que nadie se achicopale. Es el momento del temple, la serenidad y el coraje. Tenemos un líder: Antonio Ledezma. Un liderazgo templado y a la altura, enriquecido por los aportes de PODEMOS. Y seis millones de ciudadanos. Después de su primer asesinato en las montañas de Cuba, un guajiro acusado, sin pruebas, de colaborar con el ejército, le escribió a su esposa que estaba “sediento de sangre”, y de allí en adelante, bajo las órdenes de Fidel, fue responsable o ejecutor directo de innumerables asesinatos por el delito de pensar distinto. Instituyó “el odio y el terror” como política de estado, ya que consideraba que la “muerte” de los enemigos de la revolución era la única forma de construir el “socialismo” en la “patria” de Fidel, que ni siquiera era la suya. Nunca unos lemas, “Socialismo o muerte” y “Patria o muerte”, usados por el Che y Fidel, fueron tan auténticos. También fue el instrumento de Fidel para arrasar con las instituciones que presidió, gracias a su conocida incompetencia tanto en el ámbito militar como en el administrativo. Sólo fue competente asesinando disidentes. Ese fue su gran mérito y sólo por eso debería ser recordado. <br /> <br />Hoy Fidel tiene a otro Che, un militar golpista que traicionó a su juramento y a su Patria y hoy desgobierna a Venezuela. Los tiempos han cambiado y los métodos también, pero el objetivo es el mismo: instituir “el odio y el terror” como política de estado. Para eso reconstruyó el lema “Patria, socialismo o muerte” y lo está aplicando bajo la mirada complaciente de su amo. Sólo que ahora la muerte no siempre es física sino también moral. El Che venezolano está asesinando de diversas formas a los disidentes, a través del uso de los poderes y de la indigna fuerza armada como instrumentos del odio y el terror. <br /> <br />¿Cuántos venezolanos han sido asesinados, física o moralmente, como producto de la violencia que genera la impunidad? ¿Cuántos por la violencia política generada por el discurso de odio del Che venezolano. ¿Cuántos venezolanos se encuentran en las cárceles, sin sentencia o con sentencias absurdas que en el fondo son políticas? ¿Cuántos se encuentran huyendo del sistema de injusticia que impera en el país, con fiscales y jueces sumisos? ¿Cuántos compatriotas han dejado el suelo patrio buscando oportunidades porque aquí sólo las tienen los lacayos? <br /> <br />El Che venezolano también ha seguido al pie de la letra las órdenes de su amo, al arrasar con todas las instituciones. Los poderes están arrodillados ante él y los organismos públicos, con la excepción de los que sirven para perseguir a la disidencia, han sido desmantelados siguiendo el ejemplo del Che en Cuba. La venganza política y la incompetencia son los objetivos de las instituciones públicas en Venezuela.<br /><br />El mundo fue testigo del destino de los compatriotas que fueron enviados al paredón de fusilamiento moral con sentencias de hasta 30 años, mientras los verdaderos asesinos intelectuales y materiales del 11A se encuentran disfrutando las mieles de la revolución. El principal autor intelectual, por cierto, fue claramente señalado por su fiel servidor Arias Cárdenas. Todos ellos saben que los sentenciados no estarán 30 años en la cárcel, sino exactamente el mismo tiempo que les resta a ellos en el poder. <br /> <br />Quien a hierro mata, a hierro muere, reza la conseja popular. El Che, asesino, murió asesinado. El Che venezolano, tarde o temprano, será juzgado y sentenciado por los mismos tribunales que hoy, bajo sus órdenes y en mala hora, juzgan y condenan a inocentes. La justicia tarda, pero no olvida. I will simply offer you a prediction, based on feelings and guesses. <br /><br />THE ROAD TO MUGABE<br /><br />In the political scene, I believe that President Hugo Chavez will force a referendum on a constitutional reform that would allow him to be re-elected. This seems an easy prediction to make, since the National Electoral Council, led by members of Chavez's clique, are already making the arrangements for this event to take place during the first quarter of 2009. I believe Chavez will lose this referendum and that he will try to commit fraud. However, the close monitoring of the opposition and some arm-twisting from the armed forces will force him to accept the results, just as it happened in December 2007. <br /><br />Confronted with a new electoral defeat and an incoming financial crisis, Chavez will shed all remaining pretenses of democratic rule and will become openly autocratic. His speeches and actions will become much more aggressive. Nationalizations will give way to expropriations without due process. He could even declare a national emergency, formally suspending all constitutional rights and might send to prison one or more members of the opposition, under charges of corruption or of conspiring against his life or his regime. He could decide to close down GLOBOVISION and, even, El Nacional daily newspaper. <br /><br />His cabinet will be significantly modified, this time to be made up of his most unconditional followers: Carreño, Maduro, his brother Adan, Isturiz and the like. He might come to a confrontation with Cabello. In essence, he will adopt a strategy of political retrenchment, further developing a siege mentality. He will take measures that will be openly dictatorial in the economic sector. <br /><br />DEEPER INTO CHAOS<br /><br />Chavez might be forced to take several controversial financial steps during 2009: <br /><br />1). He might refuse to acknowledge Venezuelan debts, following on Correa's recent example in Ecuador. By doing this, he will attempt at negotiating with Venezuelan creditors a more favorable financial arrangement, although this would be clearly immoral and would prove to be suicidal from a national perspective, placing Venezuela in the category of a financial rogue state. <br /><br />2). He will have to face a huge fiscal deficit. His 2009 budget is close to $90 billion, bigger than Colombia's, a country with more population, and he has built it on an oil production level of 3.2 million barrels per day and an average oil price for the year of $60 a barrel. This is pure fiction, since production is closer to 2.4 million barrels per day and the average oil price could well be in the $50 per barrel during 2009. Therefore, in order to make ends meet he will have to devalue the Bolivar by about 30 percent. International borrowing is out of the question. No banks or countries will lend him more money, since China, Russia and Iran are experiencing their own acute problems. <br /><br />3). He will have to cut his social programs. He has already started to do this. He will also have to suspend help to {nicaraguan president Daniel] Ortega, [Bolivian president Evo] Morales, [Paraguayan president Fernando] Lugo, [Salvadorian presidential candidate Mauricio] Funes and [Argentine president Cristina] Kirchner. Either one of these two actions will create severe political problems for him. <br /><br />4). Levels of imports will have to be reduced. They are now at some $40 billion per year and this is unsustainable under the new financial situation. <br /><br />5). Although he would have to reduce oil exports to comply with OPEC's quota restrictions he will try to cheat because he is already producing much less than what he claims. Petroleos de Venezuela will experience severe cash flow problems, delay payments to contractors and project execution and reduce maintenance and required investments. This, in turn, will result in further loss of production in the short term. <br /><br />6). Corruption will increase, as his followers and the parasitic bureaucracy he has created will try to grab as much as they can, in case the regime collapses (raspar la olla is the Venezuelan term). <br /><br />7). Food shortages, electricity outages, labor strikes and popular protests will increase, as the regime will be unable to maintain public utilities in good operating shape and incapable to fulfill its obligations and promises to the nation. The regime will enter into a spiral from which it might not be able to recover, unless another dramatic surge in oil prices takes place. <br /><br />SOCIAL SECTOR<br /><br />Handouts to the Venezuelan poor have been the backbone of Chavez's strategy to consolidate political power. As oil income was significant he could afford to keep everyone happy at the same time. This will no longer be possible in 2009. Furthermore, Chavez will want to “punish” those that did not vote for him. He has already blamed poor sectors of the population, such as the Petare marginal area, for his electoral loss of Caracas in November 2008. The “Misiones” will start to reach less Venezuelans and this will create increasing unrest among the poor. The food distribution business will continue, although with increasing levels of corruption and inefficiency. The literacy program will be essentially abandoned since it has been unable to surpass an asymptotic 93 percent existing in Venezuela since the 1990's. Educational projects making use of the artificial satellite Simon Bolivar will die at birth, for lack of trained personnel. <br /><br />There is a small possibility of violence in the country. Venezuelans have been suffering increasing humiliations and social ailments during the Chavez regime. However, this has been a slow and systematic process, similar to the boiling of a live frog, done by careful increase of the water [political] temperature. For some years, Chavez was almost successful in boiling democratic Venezuela without the frog jumping out of the pail. However, his attempt at becoming president for life in 2007 and his renewed effort in 2008 made the frog jump out and are not going back in. Venezuelans might resort to violence to force him out but all indications suggest that this will not be necessary, as the regime is clearly imploding. <br /><br />AFTER CHAVEZ <br /><br />Although Chavez will probably survive 2009 it is time for Venezuelans to consider what will happen after he is gone. This is not an easy question, as the country is in ruins, both materially and spiritually. Political instability, financial and economic chaos and high levels of social and, even, racial, friction dominate our nation and will continue to do so for some time after Chavez is gone from the presidency. Chavez and his band will not quit politics and will continue to be an important factor of national unrest. An all out effort will have to be made to put Venezuela back on a democratic track. This makes it a good opportunity to summarize what the revolution has brought to Cuba and what is has meant for Latin America.<br />There is only one indisputable success the Castro regime can claim for the country. Cuba was the last large territory in Latin America to achieve independence from Spain (in 1898), and that freedom was diluted almost immediately, when in 1905 Cuba became a virtual American protectorate under the Platt amendment. This neocolonial status lasted until 1959, creating an enduring challenge to national identity. Castro and the revolution addressed that problem by giving the Cuban people a sense of statehood and pride. One can rightly wonder whether, after 30 years of dependence on the Soviet Union and nearly another decade of reliance on Venezuelan aid, this great national dignity is justified. But there's no doubting the strength of the sentiment.<br />As for the other, oft-touted successes of the regime, these tend to deteriorate under inspection. Take education. Yes, the country made huge gains during the first two or three decades of communist rule. But it started from a relatively high Latin American standard, and has barely treaded water ever since, producing tens of thousands of graduates in "historical materialism" and "culturology." Lacking most modern tools such as computers, Web access and current textbooks and a connection with the real economy, Cuba's supposedly excellent education system would probably compare much less well to those of other Latin American countries in a survey that didn't depend on the government's own statistics. Cuba would probably turn out to suffer the same ills as the rest of the region: formal universal education up to junior high or high school, but terribly mediocre quality and a total disconnect from TARJETAS DE CRÉDITO<br /><br />***Los US$ 400 para pagos efectuados a proveedores en el exterior desde la República Bolivariana de Venezuela se mantienen igual.<br /><br />***Autorizaciones de divisas otorgadas para viajes al exterior activadas bajo la modalidad de medios propios, estarán vigentes hasta el 05 de enero de 2009. <br /><br />El 01 de enero de 2009 entrará en vigencia la providencia Nº 093 que deroga a la providencia Nº 084, vigente desde el 27 de diciembre de 2007.<br /><br />La nueva providencia establece los requisitos, controles y trámite para la autorización de adquisición de divisas destinadas al pago de consumos en el exterior, específicamente: el pago con tarjetas de crédito de consumos de bienes y prestación de servicios efectuados con ocasión de viajes al exterior, pagos efectuados a proveedores en el exterior desde la República Bolivariana de Venezuela y la adquisición de efectivo para viajes al exterior así como los nuevos montos autorizados y la vigencia de las autorizaciones de divisas otorgadas para viajes al exterior activadas bajo la modalidad de medios propios.<br /><br />La providencia Nº 093 fue publicada en la Gaceta Oficial Nº 39.089 del 30 de diciembre de 2008 e incluye cambios respecto de su predecesora, en los artículos 10, 11, 19, 23, 24 y en las disposiciones finales.<br /><br />En el artículo 10, la normativa establece que “La Comisión de Administración de Divisas (CADIVI) podrá autorizar hasta un monto máximo de dos mil quinientos dólares de los Estados Unidos de Norteamérica (US$ 2.500) o su equivalente en otras divisas por año, es decir, en el período comprendido entre el 1° de enero y el 31 de diciembre, a cada usuario, para el pago con tarjetas de crédito de consumos de bienes y prestación de servicios, efectuados con ocasión de viajes al exterior”.<br /><br />Entre tanto, el artículo 19 señala que “Cuando se trate de tarjetas de crédito habilitadas a los fines previstos en el artículo 10 de esta Providencia, el usuario podrá disponer mensualmente de doscientos cincuenta dólares de los Estados Unidos de Norteamérica (US$ 250) deducibles del monto establecido en el referido artículo, para adelantos de efectivo en moneda extranjera, los cuales sólo podrá obtener a través de los Cajeros Automáticos ubicados en el exterior”.<br /><br />En lo que se refiere a la adquisición de efectivo para viajes al exterior, CADIVI podrá autorizar la entrega en efectivo o cheques de viajero, por una sola vez en el año calendario, es decir, en el período comprendido entre el 1° de enero y el 31 de diciembre, hasta cuatrocientos euros (€400) para usuarios con destino a los países señalados en listado publicado oficialmente en la página electrónica de CADIVI, o hasta quinientos dólares de los Estados Unidos de Norteamérica (US$ 500) para otros destinos.<br /><br />Otro de los cambios que contempla la providencia Nº 093, destaca la exclusión de la modalidad de declaración jurada ante el operador cambiario cuando el usuario se traslade a través de medios de transporte de su propiedad, tanto para la adquisición de divisas para el pago con tarjetas de crédito de consumos de bienes y prestación de servicios, efectuados con ocasión de viajes al exterior, como para la solicitud de efectivo para viajes.<br /><br />En este sentido, señala en su única disposición transitoria que “Todas las Autorizaciones de Adquisición de Divisas para el pago con tarjetas de crédito de consumos de bienes y prestación de servicios, efectuados con ocasión de viajes al exterior, otorgadas a los usuarios y que fueron originadas utilizando medio de transporte propio, se mantendrán vigentes hasta el 05 de enero de 2009”.<br /><br />Por otra parte, en las disposiciones finales de la providencia Nº 093 “Se prohíbe a los operadores cambiarios autorizados tramitar ante la Comisión de Administración de Divisas (CADIVI), la activación de tarjetas de crédito a partir del 01 de enero de 2009 a nuevos tarjetahabientes, para el pago de consumo de bienes y prestación de servicios, efectuados con ocasión de viajes al exterior, hasta tanto dicha tarjeta de crédito tenga más de seis (6) meses de requesting President George W. Bush to grant Deferred Enforce Departure (DED) to thousands of Venezuelans in the U.S., who fear returning to a country controlled by a terrorist disguised as a democrat, before he leaves office in January 20.<br /> <br />ORVEX, Organization of Venezuelans in Exile, was founded in Miami, Florida, United States of America, on April 11, 2005, as a help center for the increasing number of Venezuelans who are seeking the freedom and democracy that are being denied to them in their home country. Since October 2005, we have been advocating a temporary protection known as "DED" (Deferred Enforced Departure) for Venezuelans who fear returning to a country who is governed by a person, Hugo Chavez, who hates the U.S. as well as those who have been seeking protection in this great and wonderful country. <br /> <br />"DED" is a protection granted through an executive order given by the President of the United States.<br /> <br />On March 26, 2007, five congressman lead by Lincoln Diaz-Balart sent a letter to President George W. A government democratically elected in December of 1998 has lost its democratic course since all powers are practically in the hands of only one person, Hugo Chavez, who carries them out in an arbitrary and despotic way, and who is implanting in Venezuela a terrible regime similar to the one Fidel Castro implanted in Cuba, which is being disguised as a democracy thanks to a Media Law that encourages self censorship and to an accommodating opposition.<br /><br /> <br /><br />Among the many human rights violations committed by the Chavez regimen we have the creation of a “MAISANTA LIST” in 2003 to discriminate dissent, the murder of around 130,000 persons during his ten (10) years in power, in which an unknown number are political murders disguised as “common criminal murders”, the passing of 26 law-decrees on July 30th, 2008 to implement a constitutional reform that was rejected by the Venezuelan people on December 2nd, 2007, and his arbitrary desire of calling up a referendum to amend the Constitution, which would allow him to remain in power for life, an unconstitutional measure already rejected by the Venezuelan people.<br /><br /> <br /><br />"DED" is different from a "TPS". While a "TPS" (Temporary Protection Status) is requested by the authorities of a foreign country in favor of their nationals who are illegally in the U.S. and approved by the Secretary of Homeland Security, "DED" is an executive order issued by the President of the United States in favor of nationals whose physical and psychological integrity as well as their lives are in great danger due to extraordinary changes in the circumstances of the country.<br /><br /> <br /><br />"DED" was granted for the first time in the U.S. in 1990, and this protection has benefited groups of persons coming from LIBERIA, CHINA, HAITI and two times EL SALVADOR. Up to this date, this protection has been granted in five (5) occasions, and we are requesting President George W. El 1 % de esa cifra, ha entrado a los Estados Unidos por México, tal y como hacen los mexicanos y centroamericanos ilegales. <br /><br />Alrededor del mundo se habla de unas 2.000.000 de personas que han salido de Venezuela por la situación política del país. <br /><br />De modo que las cifras dadas por Maduro son falsas. <br /><br />Ellos, los conspiradores, quienes no tienen mayoría en Venezuela, mantienen una política de desinformación y distracción que busca tapar la política de exterminio que mantienen para desaparecer a quienes no somos parte de sus acciones delictivas. Además, se mantienen en el poder mediante un fraude electoral continuado. <br /><br />El plan de exterminio del régimen de Hugo Chávez carga a cuestas 130.000 asesinatos en 10 años, muchos de los cuales son ejecuciones políticas disfrazadas de crímenes por hampa común. The hulking concrete and brick structure takes up an entire city block and according to the Sambil Web site was to include 273 shops.<br /><br />The Venezuelan leader said it would be out of line with his government's socialist vision to allow such a mall to take up precious urban real estate _ and that unbridled consumerism isn't his idea of progress either.<br /><br />"How are we going to create socialism turning over vital public spaces to Sambil?" said Chavez, who has nationalized Venezuela's largest phone company, electric utilities and oil fields.<br /><br />The president also has urged Venezuelans to shed their materialism and their taste for designer clothes, sport utility vehicles, Scotch whisky and plastic surgery.<br /><br />Yet consumerism has flourished in recent years, with the economy awash with cash and windfall oil earnings rolling in. Revolution, Patria.” Words I heard in 1960-61 in Cuba.<br /><br />Now, almost half a century later, in Venezuela’s 5 million plus capital, I watched the local residents cheering and waving flags, a scene that looked almost identical to what I remembered in Havana when Fidel Castro launched his marathon exercises in exciting rhetoric.<br /><br />Like his Cuban mentor, Chavez offered examples of how “imperialism” — his word for the United States — had violated sovereignty, by backing the unsuccessful 2002 military coup against him and how Washington interfered in the internal affairs of smaller countries.<br /><br />What a difference the decades make! In the early 1960s, the CIA (using Cuban exiles) assassinated Cuban teachers and militia members, and sabotaged Cuban installations. I remember hearing explosions, shots, and screams from the street.<br /><br />From May through October 1960, I heard Fidel speak frequently to large crowds. He had become what Lee Lockwood called “Cuba’s living newspaper.” (Castro’s Cuba, Cuba’s Fidel, 1967)<br /><br />Almost fifty years later, Fidel’s ideological son attempts to apply some of his mentor’s rhetoric towards similar goals: to build a socialist society in a nation where oil has helped produce a capitalist mode of thinking and doing (shopping), a large wealthy class and a much larger mass of poor people.<br /><br />Fidel exported his mortal enemies to the United States. Or, Washington had a policy of importing them. Out of Cuba, wealthy exiles could only mount terrorist campaigns — for almost 50 years — but not block the dramatic changes that allowed Cuban revolutionaries to transform their island.<br /><br />Chavez doesn’t have the option of exporting the wealthy oligarchs, the business class below them and the professionals who adhere to distinctly anti-socialist values. Nor will Washington return to its old “import the anti-Castro Cubans” policy.<br /><br />He retains strong support among the poor and especially among the most conscious sectors of Venezuela’s organized working class. He also knows that if he wins the February referendum he has the chance to remain as President until 2021. As much as he admires Fidel, Chavez will not copy the economic model of Cuba. Socialism in Venezuela will eschew Soviet models for other — as yet unknown — economic arrangements.<br /><br />As Chavez has observed, eighteen years after the collapse of the Soviet Union, Cuba’s economy staggers.<br /><br />After spending a week in Caracas, I walked the streets of Havana and saw groups of young men drinking beer and singing along to reggaeton beats on portable radios or Ipods with speakers.<br /><br />“And where do these lazy bums get the money to buy beer and acquire fancy music boxes?” asks a middle aged woman in Marianao, one of Havana’s populous neighborhoods.<br /><br />“I’ll tell you where,” she answers her own question. “They steal.” Then came her anecdotes about how the criminals learn from some TV shows and put woolen ski caps over their heads and faces to conceal their identities. “One of these bums pointed a pistol at a neighbor and stole her motorbike. He had cut slits out and she saw he had green eyes. But so what? Thousands of Habaneros have green eyes.”<br /><br />I heard her complaint echoed several times. “If we don’t do something to reform the labor system here,” said a writer friend, “we’re in deep trouble. Raul [President Raul Castro] himself said so. We can’t afford to continue down this road. On top of the hurricane damage, we now face rising crime and that is obviously linked to the refusal of some young people to work at the jobs that exist.”<br /><br />He referred to three powerful super storms this year that devastated Cuban agriculture and destroyed hundred of thousands of homes. Nevertheless, Cuba’s tourist industry claimed that by year’s end some 2.3 million foreign visitors will have vacationed on the island, among them almost 700,000 Canadians. Tourism earned more than $2 billion.<br /><br />Younger Cubans I speak to express resentment “at how the old guys have risen from the grave [he meant Machado Ventura and Ramiro Valdez, who have rejoined the Politburo of Cuba’s Communist Party].” The young man spoke with passion. “I’m a committed socialist, but paternalism may kill our revolution. Will those old fogies never quit?” Yes, I think, when will the very aging leaders give the car keys to the middle aged kids? People in the mid and late 70s who have wielded power for decades and offer little originality do not exactly vibrate with inspiration at a time demanding creative and revolutionary thinking.<br /><br />Other young people recount the achievements — health, education, art, music, sports, science, as well as real human rights. But none of these past glories deals with an unjust and insufficient salary structure, with mediocre but very obedient people heading agencies containing critical and brilliant people.<br /><br />Raul’s daughter, Mariela, has spoken publicly about the urgent need to reform in several areas. Her courageous remarks about putting an end to homophobia on the island carry a sub-textual message as well. It’s time to put an end to the decades of official censorship, not only in the case of “dangerous” bloggers, but journalists who get chewed out by some of the old guard for writing “sentences you should not have written.” Indeed, I dare not mention the writer’s name for fear it will cause more problems.<br /><br />“We have too much invested in our revolution,” a writer for Juventud Rebelde told me, “to allow the old guard to ruin everything by not allowing discussion of issues everyone knows about [referring to the irrationality of the economy and the refusal to cede power]. Cuba stands for basic human rights even if the government refuses to grant some of them. Our future must be one of enjoying. Our generation, people between 30 and 60, knows that.”<br /><br />I agreed. So many people have invested their hopes and dreams in the Cuban revolution for five decades. Every time Cuba does something we think contradicts its basic revolutionary principles, we wince. “Cuba hurts,” wrote Eduardo Galeano. Right now lots of Cubans are hurting because of the condition of their daily lives. Hurricanes and a less than perfectly functioning system don’t amount to the old one two punch. But they are worrisome, especially in the context of pressure in today’s world.<br /><br />Cuba offered a vision for the future despite the paternalism and other less than democratic legacies it carried. It also stood for the embodiment of human rights, again notwithstanding the absence of a free press and a voice for the opposition in its electoral politics. Cubans had rights to food, shelter, education, medical care, old age securities — albeit not the absence of fear on the part of those who made public their criticisms of government policies. However, Cuba did not hunt down and murder “subversives” as did a gang of states, in Latin America — backed by Washington. Nor did it launch aggressive wars in Southeast Asia and the Middle East as did the United States, which officially celebrated, on December 10, the 60th anniversary of the UN’s Universal Declaration of Human Rights.<br /><br />That day should have been a day of mourning for 60 years of failure to achieve the noble goals of the Human Rights declaration. Two wars rage on in Iraq and Afghanistan, while increased global warming vitiates the right to a safe environment. Almost 3 billion people suffer the very deprivations that in 1948 were officially the targets of all the world’s governments. Some cause for celebration!<br /><br />Human rights in the United States have shrunk. In 1945, the U.S. prosecutor at Nuremberg explained that waging aggressive war was permanently outlawed. In 2003, George W. Bush waged aggressive war in Iraq. In the post World War II era, torture became a crime against humanity. In the 21st Century, Bush reauthorized it. Waterboarding became associated with U.S. jailors at Abu Ghraib in Iraq and the U.S. naval base in Guantanamo, Cuba. European allies cooperated with the United States in secretly transporting people to torture centers in other places as well.<br /><br />Meanwhile, Chavez, attacked by Washington for being antidemocratic, has expanded the breadth of human rights for Venezuelans. They now enjoy more health-care, women have gained greater equality, more poor people have learned to read and have access to potable water.<br /><br />These accomplishments coincide with the spirit of the 1948 UN Declaration on Human Rights. The letter raises serious concerns over that organization’s recently issued highly critical report on the human rights situation in Venezuela and the conduct of its president, Hugo Chavez. It is now being distributed by the Council on Hemispheric Affairs to its mailing list at the request of a number of signatories of that document. COHA’s staff is taking this step (with considerable reluctance) because it feels that it is obliged for any organization committed to social justice and democratic values, to speak out regarding the dispute now raging over HRW’s recent and very controversial report on Hugo Chavez’s human rights performance.<br /><br />Any reservation COHA may have had over taking issue with a sister organization was voided by the egregiously inappropriate behavior exhibited by HRW. Most specifically it was the issuance of this report and the needlessly venomous tone resorted to by HRW’s head for Latin America, Jose Miguel Vivanco. In his charges, HRW’s lead researcher and writer of the report used intemperate language and patently disingenuous tactics to field a series of anti-Chavez allegations that are excessive and inappropriate. It is not a matter that President Chavez and the Venezuelan government are above reproach—far from it. The problem is the presence of a mean-spirited tone and a lack of balance and fair play that characterizes Vivanco’s reportage and his tendentious interpretation of the alleged misdeeds of the Chavez revolution are demonstrably bereft of scale and accuracy.<br /><br />The failings of Vivanco’s scholarship are strongly contested by the scholars’ letter and the research compiled by a brilliant student of contemporary Venezuela, Dr. Gregory Wilpert. Entre los proyectos que se consiguieron mediante el pago de jugosas comisiones a agentes gubernamentales corruptos se encuentra el diseño y construcción de lineas de un Metro en Venezuela. <br /><br />VER VIDEO EN YOUTUBE:<br /><a href="http://">http://www.youtube.com/watch?v=SH2MECn0HAQ</a><br />Con razón la inauguración de la Linea del Metro en Los Teques, Edo. Miranda, a principios <br />de noviembre de 2006, fue toda una fiesta. <br />Aún cuando el informe del SEC no menciona con especificidad a que lineas del metro se refiere, si hubiese una Fiscalía General seria en Venezuela, esta información sería más que suficiente para iniciar una investigación por "NOTITIA CRIMINIS". <br /><br />El problema es que la Fiscalía General de la República de Venezuela está controlada por el chavismo, ese mismo que controla todas las instituciones y poderes del país, y que actualmente comete el delito de "CONSPIRAR PARA DESTRUIR LA FORMA POLITICA REPUBLICANA QUE SE HA DADO LA NACION", tipificado en el artículo 132 del Código Penal vigente. <br /><br />No sería descabellado pensar que tales comisiones no solo alimentan la voraz corrupción de los nuevos burgueses bolivarianos, llamados "boliburgueses", sino que sirven para financiar el pago de armas a los grupos civiles que persiguen y asesinan a los opositores en Venezuela. <br /><br />Para tener una idea de quienes pudieran estar involucrados en tamaña corrupción, podriamos averiguar que proyectos de metro se ejecutaron entre el 2001 y el 2007, en que estados, y quienes eran los gobernadores de dichos estados y las autoridades involucradas en el Ministerio de Infraestructura. El video arriba presentado pudiera ser revelador. <br /><br />Mientras tanto, los venezolanos conscientes debemos continuar impulsando las acciones legítimas, legales, democráticas y constitucionales amparadas en los artículos 333 y 350 de la Constitución Nacional, sin ambiguedades ni ambages, a fin de recuperar la democracia y la decencia en Venezuela. <br /><br />RUEDALO!!!! <br /><br />Ver el Comunicado del SEC (en inglés): <br />http://sec.gov/litigation/litreleases/2008/lr20829.htm<br /> <br />http://www.ruedalo.orgUnknownnoreply@blogger.com0tag:blogger.com,1999:blog-1007948602302142819.post-43727176049607112562008-12-17T08:43:00.001-08:002008-12-17T08:55:51.807-08:00HUGO CHAVEZ TIENE OTRO CASO MAS ANTE LA CORTE PENAL INTERNACIONAL EN HOLANDA<a onblur="try {parent.deselectBloggerImageGracefully();} catch(e) {}" href="http://i289.photobucket.com/albums/ll203/manwanwa/dr-hermann-escarra-rueda-de-pren-1.jpg"><img style="float:right; margin:0 0 10px 10px;cursor:pointer; cursor:hand;width: 130px; height: 98px;" src="http://i289.photobucket.com/albums/ll203/manwanwa/dr-hermann-escarra-rueda-de-pren-1.jpg" border="0" alt="" /></a><br />Un grupo de abogados venezolanos presentó ante la fiscalía de la Corte Penal Internacional (CPI) una denuncia contra el presidente Hugo Chávez por presuntos delitos de lesa humanidad. <br /><br />El representante de los presos, Hermán Escarrá, explicó a Efe que la denuncia "se amparan en el artículo 7 del Estatuto de Roma, que habla del crimen de lesa humanidad por no respetar los derechos humanos".<br /><br />Precisó que ese artículo "describe como delito de lesa humanidad cuando hay una política del Estado -no puede ser un caso particular- dirigida a producir detenciones indebidas, a producir retenciones de orden físico violando la norma internacional de los derechos humanos",<br /><br />Publicidad<br />En vigor desde julio de 2002, el Estatuto de Roma es el que regula el funcionamiento de la CPI, que, con sede en La Haya, es el primer organismo judicial internacional de carácter permanente encargado de perseguir y condenar los más graves crímenes, cometidos por individuos, en contra del Derecho Internacional.<br /><br />Escarrá especificó que a los presos se les retiene en la cárcel excediendo los plazos legales de permanencia en prisión preventiva y se les mantiene presos entre 4 y 6 años, mientras que la ley venezolana estipula que el tiempo de prisión en espera del juicio no debe exceder los dos años.<br /><br />"El Código Orgánico Procesal Penal regula los plazos, pero lamentablemente no se cumplen, al igual que la Constitución, que tampoco se cumple", indicó el letrado, quien denunció que "en Venezuela hay una dictadura disfrazada".<br /><br />El abogado aseguró que representa a "38 presos políticos y de antojo presidencial o presos personales", que son a los que se detiene a petición del presidente venezolano por motivos de talante personal.<br /><br />Como ejemplo puso el caso del "joven empresario Gustavo Arraiz, al que se le detuvo por una supuesta relación con la hija del presidente Chávez, cuando eso no fue verdad".<br /><br />"Aún así, se le abrió un expediente, se le encarceló y se persiguió a su familia", denunció el representante de los presos.<br /><br />Con la denuncia presentada hoy "estamos iniciando el trámite de apertura de un caso contra el presidente Chávez", dijo Escarrá, quien afirmó que desconoce el tiempo que los fiscales de la CPI necesitarán para analizar su demanda y decidir si abren o no un investigación contra el presidente venezolano.<br /><br />El letrado también recordó que "hay tres formas de acercarse a la Corte: a través de un Estado, a través del Consejo de Seguridad de la ONU o directamente a través de las víctimas, poniendo los hechos de relieve ante el fiscal", que es el procedimiento que se sigue con la presentación hoy de esta demanda.<br /><br />La CPI nunca comenta sobre las denuncias que se presentan ante su fiscalía, la cual solamente se pronuncia sobre las demandas que, tras el pertinente estudio de los casos, decide admitir para iniciar una investigación propia. <br /><br />HUCHUnknownnoreply@blogger.com1tag:blogger.com,1999:blog-1007948602302142819.post-1441033953425825832008-12-14T10:48:00.001-08:002008-12-14T10:48:14.540-08:00NO ES NO<a href="http://s289.photobucket.com/albums/ll203/manwanwa/?action=view¤t=termi.jpg" target="_blank"><img src="http://i289.photobucket.com/albums/ll203/manwanwa/termi.jpg" border="0" alt="HUGO CHAVEZ"></a>Unknownnoreply@blogger.com0
